Terms of Service
Last updated: October 8, 2026
These Terms of Service ("Terms") govern your use of mountaintopcyber.com (the "Site") and your purchase of services and event tickets from Mountaintop Cyber, a trade name of Mountaintop Cyber Solutions, LLC (an Idaho limited liability company) ("Mountaintop Cyber", "we", "us"). By using the Site or buying from us, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
Mountaintop Cyber is an independent cybersecurity and IT consultancy located in Idaho, United States. We provide security consulting and contract services and sell tickets to events we host. You can reach us at any time using the details in Section 15.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract to buy from us. If you buy on behalf of a company or organization, you confirm that you have authority to bind it.
3. Consulting and contract services
Consulting, assessment and contract work is performed under a written proposal, statement of work or services agreement ("SOW"). The SOW controls the scope, deliverables, schedule, fees, payment terms and acceptance criteria. If these Terms conflict with a signed SOW, the SOW controls for that engagement. Rates and descriptions shown on the Site are for general information and are not a binding offer. Our standard hourly rate is shown on the Services page in US dollars.
Unless the SOW says otherwise, you agree to give us timely access to the people, systems and information we reasonably need, and you confirm that you have authority to authorize testing, scanning or changes on any systems you ask us to assess. We will keep your confidential information confidential and use it only to perform the services.
4. Event tickets
Tickets to events we host, including Cyber Climbers, are sold under these Terms and the Event Terms and Code of Conduct. A deposit may be accepted to reserve a ticket, with the balance due before the event. Event details, including date, venue and agenda, may change, and we will notify ticket holders by email of material changes.
5. Prices, payment and taxes
All prices are in United States dollars (USD). Payments are processed by Stripe, Inc. ("Stripe"); we never see or store your full card number. By paying, you authorize us and Stripe to charge the payment method you provide. You are responsible for any applicable taxes. We may correct pricing errors and cancel orders affected by them, in which case you will receive a full refund.
6. Refunds, delivery and cancellation
Refunds are governed by our Refund Policy. Delivery and cancellation are described in our Delivery and Cancellation Policy. Both are part of these Terms.
7. Acceptable use
You agree not to: (a) violate any law or the rights of others; (b) attempt to gain unauthorized access to the Site, its servers or any account; (c) probe, scan or test the vulnerability of the Site, or interfere with its operation, except as described in Section 8; (d) use automated tools to scrape the Site or submit orders; or (e) submit false or fraudulent information or use a payment method you are not authorized to use.
8. Good-faith security research
We welcome responsible disclosure. If you find a vulnerability on this Site, please email us before disclosing it publicly, avoid accessing or modifying other people's data, avoid degrading the service, and give us a reasonable time to fix the issue. We will not pursue legal action against research that follows these guidelines. Our contact details are in our security.txt file.
9. Intellectual property
The Site and its content, including text, graphics, logos and reports we prepare, are owned by Mountaintop Cyber or its licensors and are protected by law. Unless a SOW states otherwise, deliverables prepared specifically for you may be used by you for your internal business purposes, and we keep ownership of our pre-existing tools, methods and know-how. You may not copy or republish Site content for commercial use without our written permission.
10. Third-party services and links
The Site relies on third-party services such as Stripe (payments) and Cloudflare (delivery and security), and may link to other sites. We do not control third-party services or sites and are not responsible for them. Their own terms and privacy policies apply to your use of them.
11. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Cybersecurity is a risk-reduction discipline: no assessment, report or recommendation can guarantee that a system is secure or that an incident will not occur, and nothing on the Site is legal, tax, accounting or compliance advice.
12. Limitation of liability
To the fullest extent permitted by law, Mountaintop Cyber and its owners, members, employees and contractors will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Site, an event ticket or these Terms. Our total liability for any claim arising from the Site or an event ticket is limited to the amount you paid us for that ticket or purchase. Liability for consulting services is governed by the applicable SOW. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or willful misconduct.
13. Indemnification
You agree to indemnify and hold harmless Mountaintop Cyber and its owners, members, employees and contractors from claims, damages and reasonable legal fees arising from your violation of these Terms or misuse of the Site.
14. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be brought in the state or federal courts located in Idaho, and you and we consent to their personal jurisdiction and venue. Either party may bring an individual claim in small claims court where eligible.

16. General
We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes apply to purchases made after they are posted. If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with the policies they reference and any signed SOW, are our entire agreement with you on their subject. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
